Terms of Service

These Terms of Service (the “Terms”) govern the relationship between the Administration of the OPLOT service (the “Administration”) and any person using the Service (the “User”). The Terms constitute a public offer.

1. Definitions

1.1. Service — the OPLOT software suite, consisting of the Bot, the Control Panel and the website hosting it.

1.2. Bot — the Discord application owned by the Administration that the User connects to their Server. The Bot remains the property of the Administration; the User obtains the right to use its features, not the Bot itself or its source code.

1.3. Control Panel — the web interface on the Service website through which the User configures the Bot on their Server.

1.4. Server — a community (server) on the Discord platform to which the Bot is connected.

1.5. Server Administrator — a User who holds the “Manage Server” permission on the Server.

1.6. Features — the Bot's moderation, protection and server management capabilities. Features are free or paid (Modules and Plans).

1.7. Subscription — the right to use paid Features on a specific Server for the paid period.

1.8. Activation Code — a unique code issued by the Administration that grants a Subscription without payment through the Service.

2. Subject of the Terms

2.1. The Administration provides the User with access to the Bot's Features and the Control Panel under these Terms, and the User undertakes to comply with them.

2.2. The Service provides automated moderation and protection of the Server, member management tools and other Features listed and described on the Service website.

2.3. The Administration may change the set of Features. The current list and prices of paid Features are published on the Service website.

3. Acceptance

3.1. Any of the following constitutes full and unconditional acceptance of the Terms: connecting the Bot to a Server, signing in to the Control Panel, paying for a Subscription or redeeming an Activation Code.

3.2. If the User does not agree with the Terms, they must stop using the Service.

4. Use of the Service

4.1. The User must comply with the Discord Terms of Service and Discord Community Guidelines, including age requirements.

4.2. Only a Server Administrator may connect the Bot to a Server and change its settings. The Server Administrator decides which Features are enabled on the Server and how they are configured, and is responsible for these settings.

4.4. If the Terms are violated, the Administration may, without prior notice, restrict or stop the Bot on the Server and the User's access to the Control Panel.

5. Moderation on the Server

5.1. The Bot performs moderation actions (deleting messages, warnings, restrictions, kicks and bans) automatically under rules set by the Server Administrator, or on commands of the Server's moderators.

5.2. Moderation decisions on a Server are made by its administration. The Administration of the Service is not a party to relations between Server members and the Server's administration and does not resolve disputes between them.

5.3. Automated Features work by algorithms and may make mistakes. The Server Administrator may reverse any action of the Bot.

6. Paid Features and Payment

6.1. A Subscription is purchased for a specific Server for the period selected at checkout (a month, or permanently where offered). Prices are listed on the Service website in rubles and apply at the time of payment.

6.2. Payments are processed by a partner payment provider. Card details are entered on the payment provider's side and are not shared with the Administration.

6.3. There is no automatic renewal or repeat charge. A Subscription is renewed only on the User's initiative.

6.4. A Subscription takes effect once payment is confirmed or an Activation Code is redeemed. If the same Subscription is already active on the Server, its term is extended.

6.5. When a Subscription ends, paid Features are turned off; the Server's settings are kept.

6.6. An Activation Code may be redeemed once for one Server unless stated otherwise when issued. Codes cannot be exchanged for money.

6.7. Payments are refundable if the paid Features were not provided due to the Administration's fault. In that case the Administration, at the User's choice, refunds the unused period or extends the Subscription. A refund request must be sent to the contacts in section 12 within 14 days of payment.

7. Intellectual Property

7.1. All exclusive rights to the Bot, the Control Panel, the Service website, their code, design, name and the OPLOT marks belong to the Administration.

7.2. The User retains rights to materials they publish through the Service (texts, images, settings) and grants the Administration the right to use them to the extent needed to run the Features on their Server.

8. Availability

8.1. The Service is provided “as is”. The Administration makes reasonable efforts to keep the Service running but does not guarantee uninterrupted operation.

8.2. Interruptions may occur due to scheduled and unscheduled maintenance, and due to failures of the Discord platform, network operators and other third parties.

8.3. The Administration may change, add and remove Features. If a Feature included in a paid Subscription is removed, the Administration will notify Users and offer an equivalent replacement or compensation for the remaining term.

9. Liability

9.1. The Administration is not liable for the content of messages or the actions of Server members, for decisions of a Server's administration, or for losses arising from settings chosen by the Server Administrator.

9.2. The Administration is not liable for loss of data for reasons beyond its control, including actions of a Server's administration or the Discord platform.

9.3. The Administration's total liability to the User is limited to the amount the User paid for the Subscription on the relevant Server in the last 30 days.

9.4. The parties are released from liability for failure to perform due to force majeure.

10. Term and Termination

10.1. The Terms are effective from acceptance until the User stops using the Service.

10.2. The User may stop using the Service at any time by removing the Bot from the Server. Subscription payments are not refunded in this case, except as provided in clause 6.7.

10.3. Deletion of data after the User stops using the Service is governed by the Privacy Policy.

11. Disputes and Changes

11.1. The relationship of the parties is governed by the laws of the Russian Federation.

11.2. Disputes are resolved through negotiation. A claim is sent to the contacts in section 12 and is reviewed within 30 days of receipt. If the dispute is not settled, it is referred to court as provided by law.

11.3. The Administration may change the Terms unilaterally. A new version takes effect when published on this page. Continued use of the Service means acceptance of the new version.

11.4. If any provision of the Terms is held invalid, the remaining provisions stay in force.
